 Project 2025 Could Have Been Avoided

As we witness Donald Trump's growing consolidation of power in early 2025, the consequences of a missed opportunity to protect democracy and the rule of law are becoming glaringly apparent. The warning signs were evident long before Trump’s return to power, yet a key opportunity to prevent this outcome rooted in the Constitution was ignored.

The argument is straightforward: President Biden had the authority and the responsibility to declare Trump ineligible for office under Section 3 of the 14th Amendment. This provision states that anyone engaged in insurrection or rebellion against the United States is barred from holding public office. By any reasonable interpretation, Trump’s actions surrounding the January 6th insurrection violated this constitutional safeguard.

The Legal Foundation

Section 3 of the 14th Amendment does not require Congress to enact legislation to make it enforceable. The Supreme Court ignored the fact and law that the Executive Branch enforces all laws, including the Constitution. As the leader of the executive branch, President Biden had the authority and responsibility to defend the Constitution and declare Trump ineligible.

Critics argued that such an action would be "illegal," but that assertion lacks merit. The Supreme Court’s reluctance to engage with this issue was a political calculation, not a legal one. By punting the matter to Congress, the Court sidestepped its responsibility and, in doing so, facilitated the very threat to democracy that the 14th Amendment was designed to prevent.

President Biden was responsible for enforcing the Constitution as written. His decision not to act, whether out of fear of political backlash or concern over the appearance of overreach, was a catastrophic failure of leadership. He could have ignored the Supreme Court’s erroneous decision, just as Trump will now overlook the courts to further his self-serving agenda.

The Consequences of Inaction

We see the flip side of the scenario Biden sought to avoid. Critics warned that declaring Trump ineligible might provoke violence, but Trump’s return to power will inevitably lead to violence as his authoritarian agenda unfolds. The difference is that the power to maintain democracy and the rule of law is no longer in the hands of those who value them; it now lies with Trump and his allies.

Trump has already demonstrated a willingness to ignore court decisions and legal norms that conflict with his interests. The same critics who decried the potential overreach of Biden enforcing Section 3 of the 14th Amendment must now contend with the reality of Trump wielding power unchecked. The result is a nation of authoritarianism, with democracy hanging by a thread.

A Tragic Misstep

Had Biden acted, the outcome would have been different, and he would have occupied the moral and literal high ground. Declaring Trump ineligible would have been a bold and unprecedented move, but it was legally and constitutionally justified. It would have forced the nation to confront the insurrectionist threat head-on, potentially sparking conflict and rallying the forces of democracy and the rule of law against a clear and present danger.

The Supreme Court would have declared Biden's action illegal, but Biden should have ignored the biased pro-Trump court. Democracy is at stake.

Instead, we are left with a tragic misstep that may prove impossible to overcome. Trump is now positioned to dismantle the very foundations of democracy, while those who sought to protect it are left powerless to intervene. A coup has overthrown our government on Biden's watch.

The lesson is clear: failing to act in defense of democracy when the opportunity arises only emboldens those who seek to destroy it. The nation pays the price of this failure dearly. We warned you.

  1. We started warning Biden in August 2024 and did so repeatedly through the election and after. We sent our warning to politicians, journalists, and celebrities. Apparently, they all thought we were crazy. Well, shame on all of you we wrote. Our plan would have worked. Truman, FDR, and JFK would have done it.
