A Call to Action: Defending Democracy with Bold Leadership

The Threat is Real, and the Danger Great

In the battle for the soul of our nation, those of us who oppose Trump stand united, not as a cult, but as defenders of democracy and freedom. We recognize the clear and present danger posed by Trump’s return to power—a threat not just to political norms but to the very foundations of American democracy. Yet, while we debate and warn, there seems to be no concerted, organized effort to prepare for the actual fight that may come.

This is a hard reality to confront, but we must acknowledge it. If we are serious about preserving our democracy, we need to go beyond words and take action. Now is the time to rally behind a bold, specific strategy to ensure that Trump is not allowed to return to office. That strategy has been laid out in several of my blog posts: President Biden should declare Trump ineligible for office under the 14th Amendment.

A Foolproof Proposal Against Disaster

In light of this threat, my proposal for President Biden to declare Trump ineligible for office is not radical but necessary. Section 3 of the 14th Amendment disqualifies anyone who has engaged in insurrection against the United States from holding public office. Trump’s actions on January 6, 2021, and his continued incitement of violence and sedition mark him as unfit under this law. The Supreme Court may attempt to stand in the way, but the Executive Branch, charged with upholding the Constitution, has the power and the duty to enforce this provision.

Some may claim that such decisive action would cause a constitutional crisis. But let’s be clear: the crisis has already been created, not by this bold move, but by the cult-like following of Trump and the radical agenda of Project 2025. Their relentless assault on democratic norms, their undermining of the rule of law, and their open plan to dismantle the government have already pushed us to the brink. Declaring Trump ineligible is not the cause of the crisis—it is the solution.

The argument that such a declaration would be an illegal overreach is flawed. The Executive Branch regularly enforces constitutional provisions, and to act here would be no different. What is at stake is not just a legal question but the survival of democracy itself. Biden must act decisively after Trump wins or says he has won because the consequences of inaction are dire.

The Proposal is Legal

This is not a fringe idea. I have made legal arguments in favor of this proposal, highlighting that Biden has every right and responsibility to declare Trump ineligible for office under the law. Trump's ongoing attempts to undermine democratic institutions demonstrate that this disqualification is not only appropriate but essential for preserving the rule of law.

To those who claim that such a bold move would be too drastic, consider the alternative: potentially allowing a man who led an insurrection and continues to spread lies and incite violence to hold the highest office in the land again. What could be more drastic than that? We are not merely fighting a political opponent but defending the Republic from a man and a movement determined to tear it down.

The time to act is now. We must unite behind this proposal. President Biden cannot wait for the Supreme Court or Congress to act. He must exercise his authority to protect our democracy. Let this serve as a rallying cry to all who recognize the gravity of this moment. We must be organized, determined, and unyielding in our defense of democracy. Trump’s threat is real, and our response must be equally resolute. Together, we can ensure that our nation remains free from the grip of autocracy, but only if we act now.
